These Terms & Conditions (“Terms”) govern your participation in the LOCO Rewards program (“Program”), owned and operated by [Loco Grocer Sdn Bhd] (“Company”, “we”, “us”, or “our”). By participating in the Program, you (“User”, “Shopper”, “Retailer”, “Brand”) agree to these Terms.

1. Eligibility

1.1. Shoppers:

The Program is open to individuals who are at least 18 years of age and residents of Malaysia. Participation is limited to personal, non-commercial use.

1.2. Retailers & Brands:

The Program is open to registered retailers and brands who wish to participate in offering rewards, discounts, and promotions through LOCO Rewards. By signing up, businesses agree to comply with the terms outlined herein.

1.3. Account Registration:

To participate, shoppers must register an account via the LOCO Rewards app or website. Retailers and brands must complete a partnership agreement with the Company before listing their products or stores within the Program.

2. Earning Points

2.1. How to Earn Points:

Shoppers can earn LOCO Rewards points (“Points”) by:

                  •               Making purchases from participating brands and stores.

                  •               Uploading valid purchase receipts via the LOCO Rewards app.

                  •               Participating in special promotional activities such as surveys, social media interactions, or referral programs.

2.2. Eligible Purchases:

Points are only awarded for purchases made from participating brands and retailers, as listed on the LOCO Rewards app or website. Purchases of non-participating items will not earn Points.

2.3. Receipt Upload:

Receipts must be uploaded within 7 days of the purchase date to be eligible for Points. The receipt must be legible and clearly show the date, store, and items purchased. LOCO Rewards reserves the right to reject any receipt that does not meet these requirements.

2.4. Points Calculation:

Points are calculated based on the value of eligible purchases and any applicable promotions. LOCO Rewards may offer bonus points or promotional multipliers from time to time.

2.5. Limitations:

LOCO Rewards reserves the right to limit the number of receipts or points a shopper can earn within a specified time period. Points may be revoked if fraudulent or duplicate receipts are submitted.

3. Redeeming Points

3.1. How to Redeem Points:

Shoppers can redeem Points for rewards listed in the “Rewards” section of the LOCO Rewards app or website. Rewards may include discounts, vouchers, products, or exclusive offers from participating brands and stores.

3.2. Reward Availability:

Rewards are subject to availability and may change at any time without prior notice. LOCO Rewards does not guarantee the availability of any specific reward at the time of redemption.

3.3. Redemption Process:

Once Points are redeemed, shoppers will receive a confirmation and instructions on how to claim the reward. All redemptions are final and cannot be canceled or refunded.

3.4. Point Expiration:

Points may expire 12 months after they are earned or when the campaign has ended. Shoppers can track their Points and expiration dates in their account profile.

4. Retailer & Brand Participation

4.1. Partnership Agreement:

By signing up as a participating retailer or brand, businesses agree to the terms of this agreement and any additional terms set forth in the partnership contract. Businesses must provide accurate information about their products, stores, and offers to ensure transparency with shoppers.

4.2. Promotions and Discounts:

Participating retailers and brands agree to honor the discounts, vouchers, and rewards offered through LOCO Rewards. They may run promotions or exclusive offers in collaboration with LOCO Rewards, provided all terms of such promotions are clearly communicated to the Company.

4.3. Commission and Fees:

Retailers and brands may be subject to commission fees based on sales or redemptions facilitated through LOCO Rewards. The commission rates and fee structure are outlined in the partnership agreement.

4.4. Data Sharing:

By participating, retailers and brands consent to the sharing of performance data with LOCO Rewards for reporting purposes, including sales data, customer demographics, and campaign results. All data will be handled in accordance with our Privacy Policy.

5. Spin the Wheel Campaign

5.1. Campaign Participation:

Shoppers who upload a valid receipt are eligible to participate in the Spin the Wheel campaign, which awards random points based on the spin result. The number of points awarded may vary depending on promotions and brand participation.

5.2. Spin Limits:

Each valid receipt earns one spin of the wheel. LOCO Rewards reserves the right to limit the number of spins per shopper within a specific time frame.

6. Fraud and Misuse

6.1. Prohibited Activities:

Any fraudulent activity, including submitting fake or duplicate receipts, manipulating points, or other misuse of the Program, is strictly prohibited. LOCO Rewards reserves the right to cancel points, rewards, or accounts if fraud or misuse is detected.

6.2. Account Suspension or Termination:

LOCO Rewards reserves the right to suspend or terminate accounts without notice if a user or partner is found to be in violation of these Terms. This may include the forfeiture of Points or rewards.

7. Modifications to the Program

7.1. Changes to Terms:

LOCO Rewards may, at its sole discretion, modify or update these Terms at any time. Such changes will be effective upon posting on the LOCO Rewards website or app. Continued participation in the Program constitutes acceptance of the modified Terms.

7.2. Program Modifications:

LOCO Rewards reserves the right to modify, suspend, or terminate the Program at any time, including the earning and redemption of Points, the availability of rewards, or the participation of retailers and brands. In the event of termination, LOCO Rewards will provide advance notice and give shoppers a reasonable period to redeem any outstanding Points.

8. Data Privacy

8.1. Personal Information:

LOCO Rewards collects personal information necessary to operate the Program, including contact details, purchase data, and account activity. For details on how we collect and use your information, please refer to our Privacy Policy.

8.2. Data Sharing with Partners:

By participating in LOCO Rewards, you agree that we may share your purchase data and engagement metrics with participating retailers and brands to improve their promotional strategies and marketing efforts. All data shared will be anonymized and aggregated, unless otherwise specified in our Privacy Policy.

9. Liability and Disclaimers

9.1. No Warranty:

LOCO Rewards makes no representations or warranties, express or implied, regarding the Program or rewards offered. We do not guarantee the availability, accuracy, or fitness of rewards for any specific purpose.

9.2. Limitation of Liability:

To the fullest extent permitted by law, LOCO Rewards, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your participation in the Program. This includes, but is not limited to, loss of points, rewards, data, or profits, even if we have been advised of the possibility of such damages.

9.3. Program Availability:

LOCO Rewards makes no guarantee that the Program will be available at all times or without interruption. We are not responsible for any technical issues, delays, or malfunctions that may affect your ability to participate in the Program or redeem rewards.

9.4. Third-Party Links and Offers:

LOCO Rewards may provide links to third-party websites, offers, or promotions as part of the Program. We are not responsible for the content, products, or services offered by these third-party websites or their privacy practices. Your participation in such third-party offers is at your own risk.

10. Intellectual Property

10.1. Ownership:

All trademarks, logos, and other intellectual property related to the LOCO Rewards program, including but not limited to the app, website, and promotional materials, are the property of LOCO Rewards or its licensors. Unauthorized use is strictly prohibited.

10.2. License to Use:

By participating in the Program, you are granted a limited, non-exclusive, and non-transferable license to access and use the LOCO Rewards app and website solely for personal, non-commercial purposes, in accordance with these Terms.

11. Governing Law and Dispute Resolution

11.1. Governing Law:

These Terms & Conditions and any disputes related to the Program shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

11.2. Dispute Resolution:

In the event of any dispute arising out of or in connection with the Program, the parties shall first attempt to resolve the dispute through informal negotiations. If the dispute cannot be resolved informally within 30 days, either party may refer the dispute to binding arbitration under the rules of the Malaysian Arbitration Act.

11.3. Jurisdiction:

Any legal actions or proceedings related to the Program shall be brought exclusively in the courts located in Kuala Lumpur, Malaysia, and you consent to the jurisdiction of these courts.

12. Termination of Participation

12.1. Termination by Shopper:

Shoppers may terminate their participation in the Program at any time by closing their account. Any unused Points at the time of account closure will be forfeited.

12.2. Termination by Retailer/Brand:

Retailers and brands may terminate their participation in the Program by providing written notice to LOCO Rewards. Any outstanding obligations or commissions at the time of termination must be fulfilled.

12.3. Termination by LOCO Rewards:

LOCO Rewards reserves the right to terminate any user’s or partner’s participation in the Program, with or without cause, by providing notice. Upon termination, all points, rewards, or promotions associated with the terminated account will be void.
